Terms of Service

By using 3ngram (the platform, APIs, MCP server, or website at 3ngram.ai), you agree to these terms. If you don't agree, don't use the service.

These terms are a binding agreement between you and B3dmar ApS, trading as 3ngram.

If you're using 3ngram on behalf of an organization, you confirm you have the authority to bind that organization to these terms.

What 3ngram is

3ngram is an accountability layer for AI-native work. It provides structured memory, including commitments, decisions, blockers, and preferences, that connects across AI providers via the Model Context Protocol (MCP). The service includes:

• A hosted cloud platform for memory storage, search, and accountability
• An MCP server for connecting AI tools
• APIs and integrations for third-party AI tools
• Email digests, overdue alerts, and proactive surfacing
• A web dashboard for managing your memories and commitments

Account terms

You must be at least 18 years old. Provide accurate information when you register and keep it up to date. You're responsible for everything that happens under your account, including keeping your credentials secure.

Tell us immediately if you suspect unauthorized access. We're not liable for losses from unauthorized use of your account.

Acceptable use

Use 3ngram for lawful purposes only. You agree not to:

• Store illegal, harmful, or abusive content
• Attempt to access other users' data or bypass row-level security
• Scrape, crawl, or extract data beyond normal API usage
• Reverse engineer the platform
• Store sensitive third-party data (health records, financial data, government IDs) without informed consent
• Introduce malicious code or interfere with the service
• Resell or redistribute the hosted service without written consent

API usage is subject to rate limits. Systematic abuse may result in account termination. For full acceptable use guidelines, see our Acceptable Use Policy.

Billing and subscriptions

Paid features are billed through Stripe. Current plans:

• Starter: Free, no credit card required.
• Individual: $19/month. Founding members (first 50 users): $9/month, locked in.

New accounts start with a 14-day free trial. If payment fails, there is a 7-day grace period before access is restricted.

All fees are non-refundable except where required by law. We may change pricing with 30 days' notice. Continued use after a price change means you accept the new pricing.

If you are an EU consumer, you have the right to withdraw from a purchase within 14 days. By requesting immediate access to the service, you acknowledge that you may lose your withdrawal right once the service has been fully provided.

Your content

You own everything you put into 3ngram. Memories, commitments, decisions, documents: it's all yours. You grant us a limited license to process, store, and display your content solely to provide the service.

You're responsible for the accuracy and legality of your content. We don't monitor or endorse user content.

Intellectual property

The 3ngram platform, including the MCP server, web dashboard, APIs, and all associated software, is proprietary. All rights are reserved by B3dmar ApS unless otherwise stated.

Service availability

3ngram is provided "as is" and "as available" without warranties of any kind. We don't guarantee the service will be uninterrupted, error-free, or secure. The accountability features (commitments, deadlines, reminders) are informational tools, not legal obligations.

Nothing in these terms excludes or limits rights you have under mandatory consumer protection laws.

Data retention on termination

Either party can terminate at any time. You can terminate by deleting your account or stopping use of the service.

After termination, you have 30 days to export your data via the API (GET /api/export). After that, your data is permanently deleted, including all memories, documents, embeddings, and account information. Anonymized aggregate statistics may be retained.

Limitation of liability

To the maximum extent permitted by law, 3ngram is not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability is capped at the greater of (a) what you paid us in the 12 months before the claim, or (b) €100. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify 3ngram for losses arising from your breach of these terms, your content, or your violation of any applicable law. This does not apply to the extent the loss was caused by 3ngram.

Governing law

These terms are governed by Danish law. Disputes are resolved in the courts of Copenhagen, Denmark. If you are an EU consumer, you may also use the EU Online Dispute Resolution platform. Nothing in this section overrides mandatory consumer protections in your country of residence.

Changes to these terms

We may update these terms with 30 days' notice via email or a prominent notice on the service. Continued use after the effective date means you accept the changes.

EU consumer rights

If you are a consumer in the European Union, nothing in these terms affects your rights under mandatory EU consumer protection law, including the Consumer Rights Directive.
