Terms of Service

These terms are an agreement between you and B3dmar ApS, trading as 3ngram. They apply to the hosted service, dashboard, accounts, billing, and hosted MCP and REST endpoints. If you use the service for an organization, you confirm that you can bind that organization.

The service

3ngram provides persistent, typed memory for AI tools. The hosted v1 service includes account access, memory storage and search, MCP and REST interfaces, briefings and handoffs, and a web dashboard. Capture occurs only when you or your AI explicitly submits a memory operation.

Automatic source-system synchronization, messaging bots, and outbound digests are not part of the v1 service unless a later product page expressly identifies them as available.

Accounts

You must be at least 18 and provide accurate account information. You are responsible for keeping passwords, API keys, OAuth grants, and connected-client access secure. Contact security@3ngram.ai promptly if you suspect misuse.

Subscriptions and payment

Current plans, prices, billing periods, and included features are shown on the pricing page. Free does not require a credit card. Pro has no trial: paid billing starts immediately when checkout completes. Stripe processes payment details and hosts checkout and subscription management; 3ngram does not store complete card details.

Recurring plans renew until cancelled. Cancellation timing, invoices, taxes, and any grace period follow the terms shown at checkout and in the customer portal. Fees are non-refundable except where the checkout terms or applicable law require otherwise. We will give reasonable advance notice of a material price change for an existing subscription.

Consumers retain any mandatory withdrawal, cancellation, refund, or other rights that apply in their country. Nothing in these terms waives a right that cannot legally be waived.

Your content

You own the content you submit. You grant B3dmar ApS a limited license to host, process, transmit, embed, display, back up, and return that content only as needed to provide, secure, and support the service. You are responsible for having the right to submit personal or confidential information about other people.

The hosted service does not use customer content to train a foundation model. Provider processing and retention are described in the Privacy Policy and subprocessor list.

Open source and intellectual property

The 3ngram memory engine, MCP server, REST API, SDK, CLI, and self-host backend are licensed under Apache-2.0 in the public repository. Your rights to that code are governed by its LICENSE, and these terms do not reduce those rights.

The managed dashboard, billing and cloud-operations code, hosted-service design, and 3ngram names and marks are proprietary unless expressly stated otherwise. Do not bypass access controls, interfere with the hosted service, or resell hosted access without permission.

Acceptable use

Use 3ngram lawfully. You must not:

• access another person's account or data without permission;
• probe or bypass authentication, tenant isolation, rate limits, or security controls;
• introduce malware or disrupt the service or other users;
• use the service to store or distribute illegal or abusive material;
• submit regulated or highly sensitive third-party data without an appropriate legal basis;
• use automated traffic in a way that materially degrades the service.

Export, cancellation, and deletion

While your account is active, you can export your data through the authenticated GET /api/v1/export endpoint and available dashboard controls. Export data before deleting an account.

Account deletion erases customer PII and memory content in place, revokes credentials, and invokes hosted subscription cleanup. Content-free audit and structural tombstones may remain where needed for security, integrity, legal obligations, or append-only history. Backups expire under the retention practices described in the Privacy Policy.

Availability and changes

The service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation or that a memory, search result, briefing, commitment, or deadline is complete or correct. 3ngram is an information tool, not a legal, financial, medical, or professional adviser.

We may change or discontinue service features. We will give reasonable notice when a change materially reduces a paid plan, except when immediate action is required for security, law, or reliability.

Suspension and termination

You may stop using the service or delete your account at any time. We may restrict or terminate access for non-payment, abuse, security risk, or a material breach of these terms. Where reasonable, we will provide notice and an opportunity to cure.

Liability

To the maximum extent permitted by law, B3dmar ApS is not liable for indirect, incidental, special, consequential, or punitive loss. Our aggregate liability relating to the service is limited to the greater of the fees you paid in the 12 months before the event giving rise to the claim or €100. This limit does not apply where applicable law prohibits it, including liability that cannot be excluded for fraud, wilful misconduct, death, or personal injury.

Governing law

Danish law governs these terms, and disputes are subject to the courts of Copenhagen, Denmark, except that consumers retain any mandatory protections and venue rights in their country of residence.

Changes to these terms

We may update these terms. Material changes will be announced by email or a prominent service notice before they take effect where required. The date above identifies the current version.
